As on date every FBO (Food Business Operator) or Individual engaged in the business of supply or manufacture or processing of food items are required to register with FSSAI License authority to run a business legally.

The FSS Act, 2006 divided  FSSAI license registration into the following 3 categories based on Activity, Business turnover, eligibility / Criteria etc. are:

The FBO whose yearly turnover upto Rs. 12 Lakh.

FSSAI License Number

  • The FSSAI License / Registration consist of 14 digit number which Embeds/Mentioned on the food packages or packed food items by the Manufacturer, Distributor, Importer, Retailer, Exporter etc. for the further distribution in the market.
  • The Government introduced an application through which consumer able to identify the level of hygiene and cleanliness in the Restaurant, Hotels, Food Places, Home delivery E-commerce company etc.
  • The FBO has also used FSSAI logo on their food products along with FSSAI license/registration number to ensure the business registered with FSSAI authority of India.
  • The FSSAI Logo is not a certification to the business owner for his food items but it’s only used to verify that FBO (Food Business Operator) registered under the Food Safety and Standards Act of 2006
  • If the FBO has multiple branches of manufacturing or production units then he required to mention the Name, Address, Batch number of unit on the Food packages or packed food items.
  • The FSSAI License / Registration number is mentioned on the premises of registered FBO along with Photo of the Business owner.

2. DRAFTING OF FSSAI LICENSE REGISTRATION APPLICATION

Condition For FSSAI License Registration

All the FBO (Food Business Operation) shall be required to follow the below mention instructions given by the FSSAI department for running their food business are:-

  • Show a genuine duplicate of the FSSAI License / Registration in Form C will consistently Display in the premises. 
  • Allow to Licensing Authorities or their approved officers to the Food Premises.
  • Intimate to the FSSAI authority for any Change/Modification/Alteration in Business activities or any other information.
  • The FBO shall employ Minimum one technical / Specialised person in the Unit for supervision & person shall hold a degree or Diploma in Science, Technology, any discipline related to Food business.
  • Guarantee that no item other than the item allowed in the FSSAI License/Registration to be by the manufacturer or develop in the Food unit. 
  • Keep up the production line’s clean and sterile norms and employee Hygiene as mention in the Schedule – 4 as provided by the classification of Food business. 
  • Keep up day by day records of creation, crude materials usage and sales respectively. 
  • Guarantee that the source and norms of crude material utilized are of ideal quality. 
  • FBO will not produce, store or uncover available to be purchased or grant the offer of any article of food items in any premises not successfully separated as per the general direction of the FSSAI authority from any toilet, urinal, sullage, channel or place of the capacity of dirty and waste problem.

  • FBO shall have own laboratory for testing of oil or oil-related items sample who engaged in the production business of Edible oil, Herbal oil, Vegetable oil and oil-related items otherwise no license granted by the FSSAI registering authority.
  • The Solvent-extracted oil, ‘semi-refined’ or ‘fresh standard I’, edible groundnut powder or nutritious coconut powder are sold or transfer by the FBO to the FSSAI registered FBO only who used the oil for manufacturing of any food items Except
  1. Neem oil;
  2. Kusum oil;
  3. Mahua oil;
  4. Tamarind oil;
  5. ISI Certified Groundnut powder &
  6. ISI Certified Coconut powder.
  • No unpacked or uncertified or unlabelled edible oil is sold or transfers by the FBO except specially exempted by the FSSAI authority in writing.

Validity of FSSAI License Registration

  • The FBO (Food Business Operation) FSSAI License / Registration is valid for the period of Minimum 1 year and Maximum 5 years.
  • The FBO need to decide the FSSAI License / Registration number validity period at the time of making FSSAI application for his food business & pay government fees accordingly.
  • The FSSAI authority charged the License / Registration fee as provided in the Food Security & Standard Act, 2006 and required to pay additional fees to increase the validity of FSSAI License / Registration.

Renewal of FSSAI License Registration

  • The Application for Renewal of FSSAI License Registration shall be made with FSSAI registering authority with relevant government before 30 days of the expiration of original FSSAI License / Registration.
  • The Application for renewal of FSSAI License Registration made through Form A (Basic Registration) or B (State or Central License).
  • In case of the renewal application is already made then the validity of original FSSAI License / Registration is upto maximum 30 days from date of expiry.
  • If the Renewal application is not made within the above mention timeline then the FSSAI authority will charge Rs. 100 per day for each day of delay.
  • The FBO failed to renew the FSSAI License Registration as per above mention time period then he shall stop the Food business & he required to make a fresh application if he wants to restart his food business.
  • Normally there is no requirement of Inspection in case of renewal of FSSAI License Registration but if FSSAI registering authority wants to do inspection then they have a right to inspect FBO premises before renewal after providing reason of Inspection in writing.
  • The FBO may apply for The 5 years Validity at the time of renewal of FSSAI License Registration.

Modification or Change in FSSAI License / Registration

  • The FBO required to provide all the information or documents related to any change or modification in the Business premises, Food items category, Layout Plan, Equipment, any important information etc. to the FSSAI registering authority before the occurrence of such changes.
  • There is alteration or change in the information which is mentioned in the FSSAI License Registration then FBO shall apply for approval and submit the original License with FSSAI authority along with government fees for the 1 year to incorporate such changes.
  • The FSSAI authority may issue the modified the FSSAI License Registration after making relevant changes within 30 days from date of intimation of such modification.
  • The FSSAI authority shall ensure the feasibility of the business activities & legal parameters and may issue the order of inspection of FBO business premises before providing the modified FSSAI License Registration.

Cancellation / Suspension of FSSAI License Registration

  • The FBO is unable to complete all the formalities or guidelines provided under the Improvement notice issued at the time of granting FSSAI License / Registration certificate.
  • The FSSAI registering authority has a right to suspend or cancel the FSSAI License Registration in the respect of activities for which license is granted earlier after providing the opportunity of being heard to the FBO before cancellation or suspension of license or registration as per section 32 of Foods Security & Standard Act, 2006.
  • The FSSAI registering authority shall send the copy of the reason to the FBO for which FSSAI License Registration is cancelled or suspended.
  • The FSSAI registering authority may do Inspection of FBO premises after 14 days of from the date of Suspension of FSSAI License / Registration certificate.
  • After reviewing the inspection report In the view or opinion of FSSAI registering authority that the FBO still not able to modify or incorporate such changes provided in the Improvement Notice then the authority may cancel or suspend the FSSAI License / Registration certificate after providing show-cause notice.
  • The FSSAI registering authority has the right to cancel or suspend the FBO FSSAI License Registration certificate in the Public interest after providing a proper reason in writing.
  • The FBO is not able to get any compensation or refund of government fees from FSSAI Department for the suspension or cancellation of FSSAI registration or license under this regulation.
  • The FBO may make a fresh application with FSSAI registering authority for new FSSAI License Registration along with government fees within 90 days from the date of cancellation after complied with all the changes mentioned in the Improvement Notice.

Compliance After FSSAI License Registration

  • The FBO shall file an Annual Return in Form “D-1” on or before 31st May in the following Financial Year for the previous Financial Year (1st April to 31st March) through online FSSAI portal or offline mode to Concerned FSSAI Officer for each category of Food items handled by him.
  • The FBO involved in the Manufacturing business of Milk or Milk products then he shall require to file half-year return within 1 month of due date in Form “D-2” for each Financial year & the timeline of Return are:-
  1. 1st April to 30Th September (File upto 31st October) & 
  2. 1st October to 31st March (File upto 30th April).
  • The FBO shall require to file a separate return for every FSSAI License irrespective of that he holds more than one FSSAI License.
  • FBO failed to file the return within the above mentioned Due date then FSSAI department shall charge Rs. 100 per day penalty for the period of delay.

Non-Compliance In FSSAI Act

  • Every FBO (Food Business Operation) shall follow all the rules and regulation provided in the Foods Security & Standard Act, 2006 & related regulation.
  • FSSAI department has right to inspect the FBO food business premises to check the conditions, strategies, method, hygiene, sanitation Conditions etc. & check the employee techniques used by them for production or preparation of food items.
  • If any Observation or defect is found by FSSAI authority then issued the Improvement Notice (Contain the Changes Required) in writing to FBO & such changes made by FBO with reasonable time provided by the department.
  • The FBO is not agreed with changes or modification provided by the FSSAI department through Improvement Notice he has the right to appeal in front of FSSAI State Commissioner or Appellate tribunal.
  • The FSSAI department divided the compliance into the following 3 categories are:-

  3. No Compliance.

The FBO Sell or produce or Import or pack the Food items containing Unnecessary Chemical or superfluous issue

Fine Upto Rs. 1 Lakh.

Transfer of FSSAI License Registration Certificate​

  • The Transfer of FSSAI License certificate only in case of FBO Death & application made by the Nominee or Legal Representative or any Family Member to FSSAI Authority.
  • The Application made within 90 days from date of FBO death or Such longer time beyond due date allows by FSSAI authority in writing.
  • The FSSAI registering authority has a right to approve the transfer request or reject after providing the opportunity of being heard to the applicant & record the reason provided by the applicant in writing.
  • The all the benefits & Liabilities related to FSSAI License certificate transfer to applicant & Valid upto the expiry of the License.
  • The FSSAI License certificate remains valid for the time when the application is pending before the FSSAI registering authority.

State License (1 Year) :- Rs. 9999/-
