What is Society Registration

ONLINE SOCIETY REGISTRATION

  • GOVERNING ACT

The Society is governed by the Societies Registration Ast, 1860 of the respective state in India.

 

  • REGISTERING AUTHORITY

The Registrar or Deputy Registrar or the Charity Commissioner of the area where the registered office of Society is situated.

 

  • NAME APPROVAL ACT

The name approval for Society Registration as per State Emblem of India (Prohibition of Improper Use), 2005

 

  • WHO CAN FORM

Any person {Natural person (eg. Ram, Shyam) or Artificial person (eg. The company, Entity} can form a Society as NGO, which able to do contract as per The Contract Act.

 

  • IMPORTANT DOCUMENT

The “Society By-Laws or Memorandum of Association (MOA)” is an important document for registering a Society and Its also known as rules & regulation of the Society.

 

  • MEMBERS

The minimum of 7 & no limit for maximum members is required for Society Registration with Registrar.

 

  • CONTROLLING PERSON

The Founder or Author or Authorised person or Executive members of the Society are the controlling persons.

 

  • MANAGEMENT OF ASSETS/PROPERTY

The controlling person (i.e. Founder or Author or Authorised person or Executive committee members) will able to manage the Asset/property of Society but the selling of Society Assets/property with the approval of Controlling person as per Society By-laws.

 

  • DISSOLUTION / REVOCATION OF SOCIETY

The Society is Dissolved/revoked as per the By-Laws or Memorandum of Association (MOA) after settling all its debts or Liabilities. The remaining funds of the Society shall not be distributed amongst the members but its need to transfer to society having a similar objective.

 

  • ANNUAL COMPLIANCE

Society compulsorily required to file Annual filing with the Registrar of Society along with the following details are:-

  1. Names of managing committee members;
  2. Address of managing committee members;
  3. Occupation of managing committee members;
  4. Change in managing committee members.
  • POWER TO VOTE

All members of Society have equal right of voting for any decision as per the Societies Registration Act.

 

  • RAISING OF FUNDS

Normally there is no restriction on raising of funds for Society as Societies Registration Act but the government may restrict if it is against public policy or national policy.

 

  • SOCIETY USED “FOUNDATION, SAMITI OR NGO” IN ITS NAME

 Society can be used “Foundation, Samiti Or NGO” words in the last of their Society name.

 

  • CAN FOREIGNER CAN BE MEMBER

There is no restriction on Foreigner to become a member of the Society as per Societies Registration Act but the Society may have a problem in getting FCRA/12A License.

 

  • PAYMENT TO CONTROLLING PERSON

Generally, Members have the right to receive payment except there are provisions in the Society But Professional services or consultancy are Eligible for payment. The Approval of Executive committee members approval is required.

 

  • TRANSFER OF MEMBERSHIP

There is Restriction to transfer of membership as per Societies Registration Act.

 

  • MEETINGS OF CONTROLLING PERSON

The meeting of members or boards as per the By-Laws or Memorandum of Association (MOA) of the Society and generally they need to conduct a meeting to managed day to day decision-related Society for which it is formed.

 

  • AREA OF OPERATION

The Society registered under the Societies Registration Act and It operates on National Level or throughout India and it is also registered on National level Society.

 

  • TENURE OF SOCIETY REGISTRATION

There is no limit on the tenure of Society Registration as per the Societies Registration Act.

 

  • EXECUTIVE COMMITTEE MEMBERS MEANS

The Executive committee members shall include the following person for society registration are:-

  1. President;
  2. Secretary;
  3. Vice President;
  4. Treasurer;
  5. Executive Members.

 

DOCUMENTS REQUIRED FOR ONLINE SOCIETY REGISTRATION

  • Name of Society.
  • The objective of Society.
  • PAN card of all members of the Society.
  • Identity proof of all members of the Society.
  1. Driving License or
  2. Passport or
  3. Voter ID or
  4. Aadhar Card.​
  • Address proof of members of the Society (not older than 2 months).
  1. Mobile Bill or
  2. Telephone Bill or
  3. Electricity bill or
  4. Bank Statement.
  • The registered office of Society.
  1. Property Owned ( Sale Deed or Electricity Bill) or
  2. Property Rented ( Rent Agreement)​​​​.
  • By-Laws or Memorandum of Association (MOA).
  • Identity proof of Two Witnesses.

PROCEDURE OF ONLINE SOCIETY REGISTRATION or NGO REGISTRATION

  • Check Availability of Name.
  • Preparation of By-Laws or Memorandum of Association (MOA).
  • The signing & Attestation of the following Documents by Executive committee Members are:-
  1. By-Laws or Memorandum of Association (MOA),
  2. Identity proof,
  3. Address proof,
  4. Relevant NOC/Undertaking of Executive committee Members & Witnesses.
  • Fixing the date of appointment with Sub-registrar or Charity Commissioner.
  • Appear before Sub-registrar with Executive committee Members & Witnesses.
  • Checking of By-Laws or Memorandum of Association (MOA) & relevant documents by Sub-Registrar.
  • Hearing with Sub-Registrar (if required).
  • Clicking of Photo along with Witnesses.
  • Society Registration registered in 10 Days.
